By accessing or using the ARC-OMIX platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

1. Eligibility and Accounts

The ARC-OMIX platform is intended for use by licensed healthcare professionals. To place orders, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Unauthorized use of the platform is prohibited.

2. Use of the Platform

You may use the platform to order polygenic risk score tests for your patients, review results, and use those results to support clinical decision-making. You agree not to access the platform without authorization, attempt to reverse engineer any part of it, or misuse test results outside their intended clinical purpose.

3. Orders and Payment

When you place an order, you agree to pay the price shown at checkout. Orders are processed once payment is confirmed. If a sample cannot be processed due to insufficient quality or quantity, we will notify you and work with you on next steps, which may include a replacement collection or refund consistent with our refund practices.

4. Clinical Use and Disclaimers

ARC-OMIX reports are intended to support, not replace, clinical decision-making. Results should be interpreted by a qualified clinician in the context of the patient's full clinical picture. ARC-OMIX does not provide medical advice, diagnosis, or treatment.

5. Intellectual Property

All platform content, reports, algorithms, and software are the property of ARC-OMIX or its licensors. You may not reproduce, distribute, or create derivative works from platform materials without our prior written permission.

6. Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at arc-omix.com/privacy-policy.

7. Limitation of Liability

To the maximum extent permitted by law, ARC-OMIX will not be liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim relating to the platform is limited to the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted.

8. Indemnification

You agree to indemnify and hold ARC-OMIX harmless from any claims, damages, or expenses arising from your misuse of the platform or violation of these Terms.

9. Termination

We may suspend or terminate your access to the platform if you violate these Terms or misuse the platform. Upon termination, pending orders will be handled on a case-by-case basis, and we will make reasonable efforts to notify you of any impact to in-progress orders.

10. Governing Law

These Terms are governed by the laws of the state in which ARC-OMIX is incorporated, without regard to conflict-of-laws principles. Any disputes arising under these Terms will be resolved in the courts located in that jurisdiction, unless otherwise required by law.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will post the revised Terms on this page and update the effective date above. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
